Terms of service
Plain terms for a small service. If something here is unclear, email jk@khaingsinternational.com and ask — a term you had to guess at is a term we wrote badly.
Who you are agreeing with
This service is operated by Khaings International of Vancouver, British Columbia, Canada (“we”, “us”). “You” is the person using it — in practice a vibration analyst, working on their own behalf or for an employer or client.
Khaings International Incorporated, a company incorporated under the Business Corporations Act (British Columbia), incorporation number BC1541661.
What this service does, and what it does not
You upload a measurement; we compute an analysis from it and draft a report about it. The arithmetic is deterministic — ISO 20816-3 zone classification, bearing defect frequencies computed from geometry, trend regression against history you supply. A language model writes the prose and nothing else; it does not decide the numbers.
What you get is a draft, and it is yours to sign. This service does not diagnose a machine on its own authority, does not certify anything, and is not a substitute for a qualified analyst’s judgement. Every report we produce says so on its face. The professional call — whether the finding is right, whether to act, and what to tell the people who own the machine — is yours, under your own certification. If you sign a report, you are the analyst of record, not us.
This is not a condition-monitoring service. We do not watch your machines, we do not alert you, and nothing here runs unless you upload a file.
Credits, and what one buys
Where credits are switched on, analysis is prepaid: you buy credits in packs, and one credit is spent when an analysis produces a deliverable you can put your name on — the drafted report and its PDF. Reading a spectrum in your own browser is free and stays free.
A credit is taken when we accept the job, not when the analysis finishes, so that two uploads cannot both spend the same last credit.
Two cases worth stating plainly. First, if the drafting model is unavailable or the spending budget for the day is exhausted, we still produce the full deterministic report — every number the same, without the written prose — and that counts as the deliverable and costs its credit. The report says on its face that it was produced this way. Second, if you leave an analysis waiting for you to confirm how your file should be read and never come back, the job is cleared after sixty minutes, nothing is analysed, and the credit is returned to your balance. As with every automatic return this is best-effort — if it does not come back, email us and we will restore it.
Credits do not expire. We do not run a clock on them and there is no mechanism in the service that could. If that ever changes, it changes for credits bought afterwards, and we will say so here before it does.
Refunds — two different things, kept apart
“Refund” can mean a credit coming back to your balance or money coming back to your card. They are not the same and we do not use one word for both.
A credit comes back when the analysis did not deliver. If your file fails its data quality checks, or cannot be read, or the analysis errors for any reason on our side, the credit returns to your balance and no report is produced. We deliberately return the credit for an unreadable file as well as for our own failures: a credit is a report you meant to put your name on, and charging one for a file we could not read is not defensible.
If a credit does not come back, email us and we will restore it. The automatic return is best-effort — it runs at the moment a job finishes, and if our database is unreachable in that instant the return is lost while the charge stands. We would rather tell you that than describe it as automatic and leave you to discover the exception. Restoring a credit by hand always works, so this promise holds even when the automatic path does not.
Money refunds are handled by email, not by a button. There is no refund control in this service. Write to jk@khaingsinternational.com within 30 days of a purchase and we will refund unspent credits from that purchase to the card you paid with. Spent credits are not refundable in money — the work was done and the report was produced — but if a report was not what we promised, tell us: that is a conversation, not a policy.
Where payment is enabled, the payment itself is taken by a payment processor on their own page. No card number ever reaches this service, so we could not charge or refund a card on our own; a money refund is made through that processor, who keeps their own record of the purchase. Which processor, and exactly what crosses that wire, is named on the privacy page whenever it is switched on.
Prices and tax
Prices are in United States dollars, and taxes are applied as applicable.
GST/HST is not currently collected on purchases.
What we do not warrant
We publish how well this service performs, including where it was wrong, on the validation record. That record is the whole of what we claim. We do not warrant that a report is fit for any particular purpose beyond what that record shows, that a diagnosis is correct, or that the service will be available at any particular time.
You are responsible for the measurement you upload and for what is done with the report. We are not liable for a maintenance decision, a repair, a machine, or a loss of production — those follow from a signed report, and the signature is yours. Where liability cannot be excluded by law, ours is limited to what you paid us for the analysis in question.
Nothing here limits your rights under applicable consumer protection law, which for a British Columbia consumer are not ours to write away.
Your data
What we process, what we keep and for how long is set out on the privacy page, and those are the terms — this page does not promise anything the privacy page does not. In summary: your uploaded file is deleted as soon as it has been read, your report is deleted after sixty minutes, and we do not keep a copy.
You keep every right you have in your own measurement data and in the reports produced from it. We claim no licence over them and do not use your measurements to train anything.
Closing your account
Where accounts exist, you can close yours at any time from the privacy page, or by asking us to. Everything we hold for that account is deleted. Any unspent credits are deleted with it and are not refunded — so if you have credits you want back in money, ask for the refund first and close the account afterwards.
We may suspend or close an account that is being used to attack or abuse the service. If we do that to an account with unspent credits and no abuse is established, we refund them.
Changes to these terms
We may change these terms. A change that affects what you have already bought does not apply to credits you bought before it. The date below is when this page last changed.
Governing law
These terms are governed by the laws of British Columbia, Canada, and the courts of British Columbia have jurisdiction — without taking away any right you have to bring a claim where you live.
